money back with visa - URGENT !!
Hi there,
we did order some chair, stupidly without checking on the net before, and we don't expect anything to get shipped. Until we asked for a refund, there were immediate replies, which then suddenly stopped.
Now,we are wondering how to get a refund from Visa. What did you guys do to convince the credit card company that the money was illegally withdrawn by JMC ? Strictly speaking, JMC should have some kind of order confirmation as all of the genuine web shops have as well. Can't imagine that a simple complain will do the job.
replies highly appreciated !!!
cheers, nick

Portugal again... case still pending...
Hi Nick and everybody...
This guy JMC (John Christopher) is getting worst and more dangerous each time. In other post is a complaint that they are using ebay too... just check it in this forum.
From my side I am still missing to receive a Barcelona chair that I will never receive as an year passed since the order.
I made a complaining to the Euro Consumer protection association in Portugal and they contacted their british colleagues... guesse the reply from them... 'we have several cases against these company and we can't contact them. So please go to court or try a refound from Visa'.
This being said I have been insisting with Modern Classics Direct but no replies since June.
As a long time passed Visa can not do an imediate refound and as I ordered a lot of stuff in the same payment my bank can not ask for the partial amount of the missing barcelona chair... but we are still trying a way. I can not reveal what the local Visa is trying but I will let you know later. Fingers crossed... also Visa are looking for this guy...
In the end I fell lucky... as I am only missing a barcelona chair from my original order and they sent me the money of a non supliable tolomeo some months after my order. I received the other barcelona chair, an eilleen gray table and a nice sarineen tulip.
I am planing to buy a wassily chair but I will buy it from knoll directly... no more fakes for me.
Nick... prsent a complaint to Visa imediatly asking for a refound and present all being writen in this forum and all the complaints you find in net about JMC... just google JMC furniture complaints and you will see... if you need more material let me know.
Regards
Carlos

John Christopher
I have also had some fairly disappointing dealings with this company. I have done a little digging and it would appear that Mr Christopher is now hiding in America....although is still taking orders through his modernclassicsdirect website in UK - and they have even extended their sale until Christmas.....meaning that christmas wont be coming for a few unsuspecting people.
Further digging has also uncovered that he has not paid a number of his suppliers recently either - so is no longer being supplied, meaning that he is simply taking orders (and payment) for goods that he cannot and will never supply.
Beware everyone....the man is an unscrupulous crook.

Hi people,
Just to let you know about the new messages in Modern classics direct site:
'Due to increased demand, please allow up to 3 WEEKS for UK delivery of stock items. We are currently working hard to deliver all stock orders by Christmas. Please note that we will continue to dispatch stock items until Monday December 22nd. This applies to items that are currently in stock only. If an item needs to be custom ordered please allow 12-16 weeks.'
This is fantastc... as if you place an order... after 4 months you can not complaint to VISA...

Crooks @ modernclassicdirect
My wife ordered a table through these crooks in November and paid via bank transfer as they gave her a 5% discount. What a bad move that was......
Everytmie we receive an e-mail from these people it is "I understand your frustration - we have it in stock and our warehouse will call you this week"
Have reported to Trading Stadards once I did my LATE research and found these guys are crooks. Am really pissed though that Trading Standards have not closed these guys down. They also trade under JMC all part of Cohen & Christopher Ltd. this company is DORMANT as per companies house and has never submitted a return to Inland Revenue. I'm hoping to get these guys in trouble with HMRC.
So my question is why the hell after 2 years are these guys still trading and the website has not been shut down??? The Regulators in the UK are Soooo Slack.
Anyway, am going to make a county court claim next week and will keep you all posted on progress.

Modern Classics Direct
Hi,
My case with MCD has been going on for a year and a half now. After ordering nearly £2000,00 worth of goods from the company in 2007, we have been pursuing the co. through Trading Standards, The European Consumer Centre and finally the Courts. Trading Standards simply washed their hands of us saying they are powerless to stop companies from trading??!!! the ECC were powerless to do anything because MCD ignored all correspendence from them. Finally, the Courts who found in our favour and demanded MCD to pay a full refund plus interest and court costs proved equally ineffective as MCD have ignored the County Court Ruling. Our only option now is to find a lawyer/solicitor who is willing to take on the case. Enquires so far have been fruitles as most legal firms will not take on a case where the sum to be recovered is so small. If anyone out there has any advice, I would be most grateful.

I had the same problem with them, paid and got nothing.
Still waiting for a refund but clearly I know I have no chances.
I reported this to the police though and gor a call back from them and a letter telling me they are investigating, they were nice and called to get all the info about the fraud.
This is the email where you can easily report the fraud, you ahve to put all your contact info including phone number, what happened in details, the money you lost and the details of how you paid (including their bank info if you paid via wire).
Thiese are the addressed where to report the fraud:
mailbox.internet@met.pnn.police.ukreports@banksafeonline.org.ukfrauddesk@city-of-london.pnn.police.uk
best of luck!

Just a thought with no clear understanding of UK law, why not a class action suit? With so many complaints and combined, the lost is in the tens of thousands or more? This sum being based on the accumulated complaints in this thread. Power of collective voices can't be ignored.

I
don't think such an action exists in English Law.
I did, however go past their showroom yesterday- they have recently moved to much smaller premises, and are currently having a 75% off sale....

Oh God, now it all becomes clear. I ordered a £389 Noguchi table in November. Same plausible excuses, lack of delivery date, and now silence as I ask for my money back.
Anyone successfully sued JMC?

I got my money back!
Dear All,
I am not sure how this happened, but I got my money back, this happened after a very rough exchange of emails where I informed them I reported them to the police in London and I ATTACHED THE POLICE REPORT.
In the same emails I was also telling them I was going to report them to Interpol as I live outside the UK.
I suggest you all file a fraud report with the Metropolitan Police in London, they have an email and you only have to give full details of what happened and your details so that thay can call you to get more info.
This is the email:
mailbox.internet@met.pnn.police.uk
I am so happy I got my money back that I think I'll give half of it to charity!! I hope you'll get your money back too, best of luck!
