Not Herman Miller
but it is very likely Burke. I've not seen it as a stool before, but the base looks the same as the Burke.
They did a knock-off of the La Fonda base that looks essentially the same as this one. I've seen them in sliver and also in white, often with faux walnut veneer laid into that flat spot between the vertical "legs" so it looks like there is empty space between them a la La Fonda.
that's quite presumptuous to assume
that i am the seller. i am just someone who is interested and intrigued by the piece, hence i came on here to ask for help to ID the stool. and now i know it's definitely not a HM/nelson piece.
so jdip and perhaps glassartist as well actually think that i am the seller who came on here and ask for verification on the authenticity of the piece, found out that it's not a HM piece and then i go ahead and try to sell it as a HM piece, in other words, to scam people?
jdip and glassartist. you should have a bit more good faith in people or at least find out more facts before assuming and making false accusation like that.

Hence
my question mark. Don't throw an accusation I did not make. The question mark was specifically for who is the seller and is this the same one. Sorry if I made you jumpy.
Also, the scenario you just spelled out happens all the time with ebay sellers and incorrect attributions. Those that are shopping often just post the link to the auction.
Did the seller send you the additional pics? Or is that of one you have just like it?
